These terms and conditions govern the mutual rights and obligations of the seller - MgA. et MgA. Magdalena Šťastníková, with its registered office at Ruprechtická 1336, Liberec 1, ID: 10852808, operating under the Trade Licensing Act of the Czech Republic, and the buyer arising from or in connection with a purchase contract concluded between them through the seller's online store. These relations are primarily governed by Act No. 89/2012 Coll., the Civil Code, as amended, and Act No. 634/1992 Coll., on Consumer Protection, as amended.


Definitions:

SELLER: The seller is a person who, when concluding and fulfilling the contract, acts within the scope of their commercial and business activities and supplies goods to the buyer.

BUYER: The buyer is a person who orders goods from the seller and concludes a purchase contract with the seller through the seller's e-shop.

CONSUMER: The consumer is a buyer who purchases goods or uses services and does not act within the scope of their business activities or as part of the independent exercise of their profession.

Order:

The buyer may order goods via the order form on the website https://stastnikova.com/e-shop. By placing an order, the buyer confirms that they have reviewed these terms and conditions, that they are aware that the relationship between the seller and the buyer is governed by these terms and conditions, which are binding on both parties, and that they agree to these terms and conditions.

The buyer is required to provide truthful information requested by the seller in the order so that the purchase contract can be properly concluded.


Purchase contract:

The display of goods on our e-shop is considered an invitation to submit offers, and an order for goods is considered an offer to conclude a purchase contract. The seller is not bound by the display of goods on their website, and the purchase contract is concluded upon the seller's acceptance and confirmation of the buyer's order. The application of Section 1732, paragraph 2 of the Civil Code is excluded for the purposes of regulating the relationship between the seller and the buyer in accordance with the law.


Prices, delivery of goods and payments:

The price of goods in the online store may differ from the price in the physical store, seller's premises/studio, exhibition, or other sales events. In the event of stock depletion, the buyer will be promptly informed and given the opportunity to specify whether they would like a replacement item or wish to cancel the order.

The cost of delivery is specified in the online store when placing the order. If the buyer requests special delivery and the seller agrees, the seller may charge additional costs for such delivery. Delivery options are also specified in the online store at the time of placing the order.

Ordered goods are always shipped only after payment has been received. The seller informs the buyer that the offered goods are exclusive, handmade from precious metals and are therefore produced in limited quantities. If the goods are out of stock, the seller will inform the buyer, and the delivery time may be several weeks or the order may not be fulfilled. The seller also informs the buyer that due to the handmade nature of the goods and the fact that each item is unique, the ordered product may slightly differ from the photograph on the e-shop.

Goods can be paid for in the currency and by the methods specified directly in the e-shop. The prices for goods and shipping stated on the website are final.

The buyer pays for goods purchased on the e-shop through the Stripe payment gateway.


The seller fulfills the delivery of goods by handing over the goods to the buyer or to the carrier, thereby transferring the risk of damage to the goods to the buyer. The availability of the product is always stated in the product details. The delivery time depends on product availability, payment terms, and delivery conditions. Goods that are in stock will be dispatched within 3 business days from the payment of the full purchase price, i.e., from the moment the corresponding amount is credited to the seller's account.

For made-to-order goods, the delivery time depends on the information provided in the product details after payment of the full purchase price, i.e., from the moment the corresponding amount is credited to the seller's account.

Along with the shipment, the buyer will receive a invoice.


Goods are sent worldwide via:


- Zásilkovna (to Czech Republic and Slovakia) for 4 EUR and the delivery time is usually up to 3 working days

- EMS via Czech Post (to Europian Union) for 10 EUR and the delivery time is usually up to 7 working days

- express package via Czech Post (out of EU) for 20 EUR and the delivery time can take up to 14 working days



Personal pick up is possible at the showroom located Moravská 13, Prague 2 by prior agreement.


Returns and complaints:

As a final consumer, you can return any goods without giving a reason within 14 days of receiving the shipment.

- All returned items must be in its original condition, unused and undamaged

- All returned items must be cumplete with all original tags and packagind

- The return must be posted in a secure outer box

Refunds may take up to 5 working days to reach your account, depending your payment method. Payments will be refunded to the original payment method excluding the cost of shipping.


The warranty period is 24 months for individuals and 12 months for legal entities. The invoice serves as the warranty certificate. The warranty does not cover wear and tear caused by the use of the goods. The buyer is obliged to make a complaint immediately after the defect occurs. In the case of a demonstrable manufacturing defect, the buyer has the right to repair or replacement of the goods. Complaints do not apply in cases where the defect or damage is demonstrably caused by improper use, in violation of the instructions for use, or by other improper actions by the buyer, or by demonstrable unauthorized interference with the goods, and to defects that arise from normal wear and tear of consumable goods. For such damaged goods, the seller may agree to repair the goods for an agreed amount if the repair is possible. The complained goods must be sent properly packed to prevent damage during transport. The buyer bears the costs associated with sending the complained goods to us. In the case of a successful resolution of the complaint, the repaired or replaced goods will be sent back to the customer at the seller's expense. The maximum time for handling a complaint is legally set at 30 days.



Data Protection:


According to Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation"), the Seller informs the Buyer that as the data controller, it processes their personal data. The personal data processed includes: name and surname, address, bank account number, email address, phone number, and IP address (network interface identifier). The legal basis for processing personal data is, according to Article 6(1)(b) of the Regulation, the performance of the contract, and additionally, according to Article 6(1)(f) of the Regulation, the protection of the legitimate interests of the Seller as the data controller, and also according to Article 6(1)(c) of the Regulation, compliance with a legal obligation. The purpose of processing personal data is to fulfill obligations under the purchase contract, compliance with public law obligations (accounting, tax, and archival), and communication and offering products and services, including sending information about organized events, products, and other marketing activities of the controller, as well as sending commercial communications. Personal data will be stored for 10 years from the end of the contractual relationship, in accordance with the obligation to archive invoices and contracts based on national accounting and tax legislation. The Seller does not engage in automated individual decision-making within the meaning of Article 22 of the Regulation. Personal data may be processed by a processor based on a contractual relationship with the controller. Personal data will not be transferred to third countries. Under the conditions specified in the Regulation, the Buyer as the data subject has the right to request access to personal data, the right to rectify or erase personal data, or restrict its processing, the right to object to the processing of personal data, and the right to data portability. If the Buyer believes that the processing of their personal data has been or is being conducted in violation of the Regulation, they have the right to lodge a complaint with a supervisory authority. The data subject has the right to object to the processing of personal data. Changes to Terms and Conditions:

The Seller is entitled to unilaterally change these terms and conditions to a reasonable extent. The Seller will inform about changes on their website at https://stastnikova.com/e-shop, where the current version of the terms and conditions can be found.



Protection of Intellectual Property:

The Buyer acknowledges that the Seller's goods are subject to international protection of intellectual and industrial property, particularly trademark rights and copyright protection, and acknowledges that they are not authorized to copy or use the Seller’s goods or trademarks associated with these goods in violation of applicable legal regulations. Infringement of intellectual property rights may be considered
a criminal offense. All rights in this regard are enforced by the Seller’s law firm, and the infringer bears the associated costs.

These terms and conditions come into effect on August 24, 2024.
